How an early Scottish election can be triggered

Opinions differ on how possible/probable the options of a consultative referendum or early Holyrood election are in the event that Theresa May remains intransigent.  Brian Taylor of the BBC, for example, acknowledges that both options are on the table, but insists that both are "unlikely" because Nicola Sturgeon would regard them as "gestures".  Whether he's being led by his own assumptions and preconceptions, or whether he's been reliably briefed to that effect, is anyone's guess.

However, as there seems to be some confusion over exactly how an early Holyrood election can be brought about, it might be worth refreshing our memories by looking at the relevant part of the Scotland Act.

"The Presiding Officer shall propose a day for the holding of a poll if—

(a) the Parliament resolves that it should be dissolved and, if the resolution is passed on a division, the number of members voting in favour of it is not less than two-thirds of the total number of seats for members of the Parliament, or

(b) any period during which the Parliament is required under section 46 to nominate one of its members for appointment as First Minister ends without such a nomination being made."

The crucial word is "or". Options a) and b) are either/or - they don't both have to be met.  In other words, if the First Minister resigns and is not replaced within 28 days, an election is triggered without the need for a two-thirds majority, and the unionist parties would not have the opportunity to form a blocking minority.

There is, however, a small catch.  If there is an election for First Minister during the 28 days and only one unionist candidate is nominated, there will be an "affirmative vote" and that person will be rejected.  If, however, at least two candidates come forward (say, Ruth Davidson and Kezia Dugdale), it wouldn't be possible to stop one of them from being elected.  That's basically because the rules are a bit silly.  If Davidson received the votes of the 31 Tory MSPs, and Dugdale received the votes of the 24 Labour MSPs, the vote would be declared valid and Davidson would technically become First Minister.  That's not a problem in itself, because the "Davidson government" would, within a few short days, be ousted by a vote of no confidence.  However, that would simply start the 28-day process all over again, and in theory we could go round in circles into infinity.

In practice, that wouldn't happen, because the unionist parties would be worried about making themselves look ridiculous, and people would be chanting "politics is not a game" at them.  However, we should probably be prepared for them to attempt the stunt at least once.  Personally, I don't think that would be the end of the world.

  2. Unionists and HM press are conveniently forgetting that the Scottish Government put forward a number of reasonable proposals to keep Scotland in the UK but as part of the European Single market as well.
    These have been rejected by May and her clowns out of hand,with no discussion.
    May is the one who has brought about this constitutional crisis and she must be the one to bear responsibility for what happens next.
    We must not be put on the back foot by the unionists claiming that we are the ones using these circumstances as an excuse for independence.
    The ball was and still is in London's court to avoid all this mess.
    Their fixation with retaining centralised control over the British Isles is at the core of matters.
    Her failure to take us seriously will cost her dear.

  3. We already have a mandate from the Scottish people. We'd play into their hands by holding an early election. If we play by Westminster's rules we may well lose. I'm inclining more to Craig Murray's view that we might have to call a National Assembly and declare independence.

    I'm sure Nicola and her team have thought through all the options and I trust them to make the right decision.

  4. I am not in favour of using the unpredictable d'Hondt voting system, and number of MSPs elected, as a vehicle for trying to obtain Independence. The numbers are just too close for comfort. In my view one of the reasons May wants to kick the Scot Ref into the future is in the hope that the HR election in 2021 might result in NO majority for Indy Ref or Indy. 4 years is a very long time in politics and Greens' support of Indy could dwindle not to mention internal and external SNP support, during a period of 4 years of incessant negativity in the MSM.

    Far better if all SNP MPs at WM resigned and stood in the ensuing first past the post by-elections on a platform of Independence. But is that possible under WM voting/resignation rules even assuming the MPs agreed? Could WM decide to postpone the by-elections?

    Holding a wee pretendy referendum will achieve precisely nothing. It achieved precisely nothing for the Catalans (unless you count their leader being threatened with jail). They ended up exactly where we'll end up - telling the bullies where to shove their laws. So let's skip the wee pretendy referendum bit entirely just cut to the chase!

    What realistic strategy do we have for achieving Scottish independence? And no - it's not my job to suggest what it should be. I'm not being paid sixty grand a year like they are.

    No more begging and sabre rattling. No more divide-and-conquer "referendums" - pretendy or otherwise. If we continue to play by their rules we're going to be shafted by their rules.

    Even if May gives her "royal assent" to a second referendum, I will refuse to vote in it. The patience of many hundreds of thousands of lifelong independence-supporting Scots like me cannot be taken for granted forever.

I get the similarity, but the Scotland case is simpler and more just as it is England breaking its commitments to Europe while the Scots wish to remain in union. Not voting is just misguided.people have had to fight many battles to get their freedom. In many places, people died. Winning an election and not getting it so you give up? Really.

We have a serious problem in Scotland where views that differ from the pro-nationalist, pro-independence lobby are seen as stupid, irrelevant, anti-Scottish, doing our nation down etc. The nationalists are stirring up enormous strife and bitterness in Scotland through seeking change which they themselves patently do not understand, other than at a superficial level ie that of independence. Change that is not understood cannot be managed. And change that is not managed is folly.

    The thinking was, in most of the saner parts of SLAB, that whatever else happened they wouldn't be the tories fall guys and human shield this time around for Indyref2.

    Well they ain't too sure about that now! :D

    Dugdale is beginning to look plenty daft enough to put herself or some other poor SLAB Labour fool directly in the line of fire yet again.

    After all, the Browntervention was agreed in a huddled meeting in with her, Sarwar and Broon.

    Very much outside the grassroots pay grade you understand. ;)

    Wee Ruthie Davidson seems to think they are that daft as well and will breathe a heavy sigh of relief as she can continue to mop up the carnage and ex-SLAB voters when the Scottish Labour cannon-fodder goes over the top to protect the tories from the scottish public's ire.

  15. Strugglin can call an early election, but the Westminster veto will still apply.

    She can hold an illegitimate referendum. But it would carry no legal weight and be boycotted.

    You've ran up against a brick wall. Not because the UK is undemocratic or the tories dictatorial - but because you lost an independence referendum 2 years ago. Now you have to repair the neglected Scottish public services, grow the economy, reduce the deficit, prepare a plan for independence (a proper one, not a load of spin), and wait until brexit is complete and bedded in. Then and only then - in ten years or so - you can have another go. Not before.

  24. The independence movement does not rely on nor shift according to opinion polls. We do our talking at the ballot box. We won a majority at WM and have an independence majority at Holyrood. That's not opinion that's fact. When our parliament votes for indi 2 next week. It's because the majority of Scots agreed with it in the ballot box.

    Last week one rogue poll had indi support at 43%. The rest at 47%. They are not reliable and are not factual. They are snapshots of opinion. We vote next week as per the mandate even if it doesn't suit May and Davidson.

    We follow the right path and rely on truth and honesty. Brexit is a monumental disaster and the Tories are sociopathic in their policies.
